Through the instant writ petition, the petitioner/workman has challenged the award dated 11.01.2017 rendered by the Industrial Tribunal, Faridabad, whereby the reference was answered against him. 2.

During the pendency of the instant writ petition, the workman unfortunately passed away. Consequently, the relief sought for his reinstatement does not survive. The only issue that remains for adjudication is whether his legal representatives are entitled to lump-sum compensation. 3.

Learned counsel for the respondent No.1/management submits that, in view of the demise of the workman, the management, as a gesture of compassion towards his legal representatives and to uphold its commitment as a model employer dedicated to the welfare of its workmen, is willing to pay a sum of ₹5,00,000/- as lump-sum compensation to settle the dispute in toto.

Learned counsel for the workman, while joining issue on merits, submits, on instructions, that the legal representatives of the deceased workman are agreeable to a full and final settlement of the dispute upon payment of ₹5,50,000/- as lump-sum compensation by the management.

After hearing learned counsel for the parties and considering the peculiar facts and circumstances of the case, this Court is of the considered view that the dispute can be brought to a quietus by enhancing the amount offered by the management by a further sum of ₹50,000/-. Accordingly, the management is directed to pay a total sum of ₹5,50,000/- as lump-sum compensation to the legal representatives of the deceased workman. The compensation amount, as requested by learned counsel for the workman on instructions, shall be deposited in the bank account of the workman's wife, the particulars whereof are set out hereunder, within a period of three months from the date of receipt of a certified copy of this order, failing which the said amount shall carry interest @ 9% per annum.
