Mr. Madhur Panwar, Advocate, for the petitioner. ***** HARSIMRAN SINGH SETHI , J. (ORAL) Learned counsel for the petitioner submits that the petitioner had availed maternity leave from 02.04.2021 to 30.09.2021, but the salary for the said period has not been released to the petitioner and that too without any valid justification, hence, the respondents are under an obligation to release the salary for the period concerned during which, the petitioner had availed maternity leave.

Learned counsel for the petitioner further submits that the grievance as raised in the present petition has already been raised in the representation dated 20.06.2023, copy of which has been appended as Annexure P-12. The petitioner will be satisfied, at this stage, in case a direction is issued to respondent No. 3 to decide the said representation by passing an appropriate speaking order in a time bound manner. Notice of motion.

CWP No.16464 of 2023 --2-- 2023:PHHC:098687 On the asking of the Court, Mr. Pankaj Middha, Addl. A.G., Haryana, who is present in Court, accepts notice on behalf of the respondents and raises no objection in deciding the representation dated 20.06.2023 (Annexure P-12) in a time bound manner by passing an appropriate speaking order.

In view of the pleadings in the present petition, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No. 3 is directed to decide the representation dated 20.06.2023 (Annexure P-12), by passing a speaking order within a period of eight weeks from the date of receipt of a certified copy of this order and in case, petitioners are found entitled for any benefit after the said decision, the same will be extended to the petitioners within a further period of four weeks thereafter.

Present writ petition stands disposed of.
