This matter is being taken up for hearing through video conferencing due to the outbreak of pandemic, COVID-19.

Petitioner has filed this writ petition being aggrieved of the action of the respondent- Commission in not considering him eligible for selection to the post of PGT (Geography) on the ground that result of his qualifying examination i.e. B.Ed. was not officially declared before the cut of date i.e. 12.10.2015 whereas it is the case of the petitioner that his confidential result was issued by the M.D. University, Rohtak on 16.09.2015.

While issuing notice of motion in this case on 10.09.2018, petitioner was permitted to participate provisionally in the selection process. Accordingly, he was permitted to participate in the selection process. Petitioner's result, who had applied for the post of PGT (Geography) Mewat as well as Rest of Haryana, was kept in sealed cover. CWP-22946-2018 (O&M) -2been produced through e-mail/whatsapp group created for the purpose of video conferencing today. Perusal of the same reveals that petitioner has secured 121 marks i.e. 110 written examination and 11 in the interview. Learned counsel for the State does not deny that the last selected candidate having secured 107 marks, petitioner is eligible for appointment in terms of judgment of Hon'ble Supreme Court in Haryana Staff Selection Commission Vs. Priyanka and others, 2021(4) SCT 80. However, it is to be noted that learned counsel for the petitioner and learned counsel for the State admit that pursuant to decision of the Hon'ble Supreme Court in Priyanka's case (supra), the entire result is subject to revision. Keeping in view the facts and circumstances as noted above, this writ petition is disposed of with a direction to the competent authority to consider the petitioner's candidature for the post of PGT Geography, in terms of the judgment of Hon'ble Supreme Court in Priyanka's case (supra) and necessary action be taken accordingly.
