The petitioners have challenged the Ist respondent's decision to consider the second respondent's bid. 2.
The petitioners contend that the second respondent's bid was non-responsive on account of his not having filed the required form stating the period for which the offer is kept open. 3.
Mr. Puri, the learned counsel appearing on behalf of respondent No.1 states that in view of the judgment of this Court dated 23.12.2015 in the case of Khem Singh vs. Food Corporation of India and others, CWP No.23472 of 2015, the Ist respondent has considered the 2nd respondent's bid to be non-responsive. The petitioners further seek an order directing the respondents to allot the work to the next financially and technically eligible candidate i.e. the petitioners. 5.
We are not inclined to grant this relief. It is for the Ist respondent to decide the manner in which it would like to obtain the most favourable price in respect of the said contract. 6.
The petition is accordingly disposed of.
