Jaswant Singh,J.(Oral) Unsuccessful rival for the office of Lamberdar of Village Sultanpur, Tehsil Hansi, District Hisar has filed the present petition after a delay of almost 11⁄2 years assailing the order dated 19.11.2013 (P-3) passed by revisional authority/Financial Commissioner, Haryana whereby the appointment of respondent no.4-Dariya Singh by the Collector vide order dated 17.11.2012 and the order dated 1.4.2013(P2) passed by the appellate authority (Commissioner, Hisar) were upheld.
Having heard learned counsel for the petitioner, this Court is of the opinion that the present petition is totally frivolous. The learned appellate authority in its order dated 1.4.2013 (P-2) has in detail considered the competing claims of the appointed candidate Dariya Singh and the present petitioner and found that Dariya Singh was most suitable. It is further apparent that said Dariya Singh was son of previous deceased Lamberdar and had knowledge of RAJINDER PRASHAD JOSHI 2015.03.13 16:31 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CWP 4387/2015 Lamberdari work. There appears to be no serious infirmity which could come in the way of appointment of Dariya Singh as Lamberdar. The revisional authority in the light of merits and demerits having been compared has upheld the orders passed by the appellate authority. In view of the above, no case for interference is made out. Hence the present writ petition is dismissed with costs of Rs.10,000/- (Rupees ten thousand only) to be deposited with District Legal Service Authority,Hisar within a period of one month from today failing which Member Secretary, District Legal Service Authority, Hisar shall take steps to recover the said costs as arrears of land revenue. 13.03.2015.
