The petitioner claims an alternative plot in lieu of the one that was allotted to it in the year 2000. 2.

According to petitioner, the respondents have been unable to complete the allotment on account of a pending litigation. The petitioner further submits that as per the policy in force, it is entitled to an alternative plot. An application in this regard was made on 25.03.2015 (Annexure P/6). 3.

It is for the respondents, in the first instance, to decide whether or not an alternative plot ought to be granted. There would be several factors to be taken into consideration before taking the decision including the status of the present litigation and the availability of suitable alternative plot. This, of course, is assuming that the respondents are bound to allot an alternative plot. That would depend, inter alia, upon the existing policy.
