The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondents No. 1 and 2 to re-issue his passport.

Learned counsel for the petitioner inter alia submits that FIR No. 39 dated 30.04.2021, under Sections 307, 506, 148 and 149 of IPC and Section 25/27 of Arms Act was registered against the petitioner at Police Station Makhu, District Ferozepur, however, police during investigation, found the petitioner innocent. Accordingly, no challan was presented against the petitioner.

Mr. Deepanjay Sharma, DAG, Punjab submits that PARAMJIT KAUR SAINI 2023.08.03 15:59 I attest to the accuracy and authenticity of this order/judgment

CWP-16607 of 2023 -2- 2023:PHHC:099538 petitioner has been found innocent in aforesaid FIR, however, report with respect to pendency of any other FIR is under preparation The authority concerned would prepare report with respect to any other FIR pending against the petitioner within two weeks from today and forward the same to passport authority.

Mr. Himanshu Malik, Advocate for Union of India submits that as soon as police report is received from the quarter concerned, application of the petitioner would be processed, in accordance with law. 5.

In view of statement of both sides, the petition stands disposed of with a direction to passport authority to process application of the petitioner within four weeks from the date of receipt of police verification report.
