The present litigation is the result of a motor vehicular accident that occurred on 20.08.2007. The appellant was travelling in a car bearing registration No.HR-01J-0533. The said car was hit by a tractor trolley. As a result of the accident, appellant suffered injuries and resulted into 19% permanent disability qua hearing.
Learned counsel for the appellant at the outset has stated that certain complications have arisen after the accident. Further evidence is required to be produced to prove the same so that compensation can be enhanced.
During the pendency of the appeal, cross-objections have been filed by Insurance Company which are accompanied with an application for Anju 2017.12.08 16:43 I attest to the accuracy and integrity of this document High court chandigarh

Since the prayer made by learned counsel for the appellant is that more evidence is required to be adduced to show the effect of disability and to show that it has resulted into further complications, without expressing any opinion on the merits either on the appeal or on the crossobjections, it is deemed appropriate to remit the matter back to the Tribunal to decide afresh in accordance with law. Both the parties shall be at liberty to adduce afresh evidence, if so required.
Parties are directed to appear before the Tribunal on 19.01.2018.
The appeal is disposed of accordingly.
