The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking issuance of a writ of mandamus directing the respondents to place the petitioners in the Special/Dying cadre created under the Policy dated 16.05.2023 and to grant them minimum pay scale + dearness allowance + grade pay with all consequential benefits from the date when it became due and rectify the fudged/manipulated service records of the petitioners in view of the directions issued by this Court in CWP-19238-2013 titled as 'Amrish Sharma and others Vs. State of Punjab and others, decided on 26.02.2024 (Annexure P-3) as the petitioners are fully eligible and entitled for the same.

Learned counsel for the petitioners submits that for redressal of their grievances, the petitioners have also served legal notice dated 04.05.2026 (Annexure P-5) to the respondents which is still pending consideration. He further submits that at this stage, the petitioners would be satisfied, if appropriate directions are issued to the VINOD KOTHIYAL 2026.05.29 17:24 I attest to the accuracy and authenticity of this document

Mr. Surya Kumar, A.A.G., Punjab, accepts notice on behalf of the respondents-State. He has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to consider and decide legal notice dated 04.05.2026 (Annexure P-5) submitted by the petitioners expeditiously, by passing a speaking order after affording an opportunity of hearing to the petitioners, preferably within a period of 04 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioners.
