Service waived qua the sole respondent, as Mr. J.S. Puri, Advocate, accepts notice on its behalf. 3.

The petitioner's objection is to the terms and conditions in the Notice Inviting Tender (NIT) for transportation contract. According to petitioner, the basic rate is wrongly mentioned in the NIT on the basis of 11.30 kilometres, although the actual distance is only 11.10 kilometres.

Mr. Puri, the learned counsel appearing on behalf of the respondent, states that the respondent has decided to ascertain the correctness of this assertion and that it will proceed further with the bids already received pursuant to the NIT only in the event of it's finding that the basic rate was computed on the basis of the actual measurement of the road.
