This petition has been filed under Section 482 of BNSS, 2023, seeking anticipatory bail in case FIR No.255 dated 03.05.2025, under Sections 115, 140(3), 351(2), 324(4), 3(5) and 61(2) of BNS, registered at Police Station Gharaunda, District Karnal. 2.

On 13.06.2025, the following order was passed:- "XX XX XX XX

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case being the real sister of main accused Balkar Singh who allegedly kidnapped his son from the custody of his ex wife Seema. The petitioner has not been named in the aforesaid FIR and the only allegation against the petitioner is that the minor child was recovered from her custody. The main accused was released on regular bail by the learned Trial Court after observing that the records indicate that the last judicial operative order qua the custody of the minor son MOHD YAKUB 2025.07.25 15:08 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CRM-M-32400-2025 was in favour of the accused. The petitioner is ready to join the investigation and co-operate.

3. Notice of motion.

4. At the asking of the Court, Mr. Brijesh Sharma, AAG, Haryana, accepts notice on behalf of respondentState and prays for time to file reply.

5. Adjourned to 25.07.2025.

6. Meanwhile, the petitioner is directed to join the investigation and appear before the investigating agency as and when called upon to do so. In the event of her arrest, she shall be admitted to interim bail on her furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C./482(2) of the BNSS, 2023."

Learned State counsel, on instructions from ASI Jai Bhagwan, at the very outset, informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required. 4.

In view of the statement of learned State counsel, order dated 13.06.2025 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (erstwhile Section 438(2) of the Code of Criminal Procedure, 1973). 5.

The petition stands disposed of.
