Advocate General, Punjab. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner, who has no criminal antecedents, apprehends her arrest in respect of offence of cheating and criminal conspiracy in FIR No. 104 dated 26.04.2025 under Sections 420, 120-B of the Indian Penal Code, registered at Police Station Dera Bassi, SAS Nagar, Mohali, arising out of allegation made by the complainant that petitioner alongwith other close relatives (excluding the complainant) entered his name in the revenue record as the legal heirs of their deceased mother who had died sometime in the year 2016.

Other co-accused, namely, Avtar Singh, Kamlesh Kaur and Savaran Kaur have already been extended the benefit of anticipatory bail vide order dated 12.05.2025 passed in CRM M No. 25721 of 2025 and order dated 29.05.2025 passed in CRM M No. 30411 of 2025. Since there are no criminal antecedents against the petitioner and also that the petitioner is a woman aged about 68 years, who may not be able to bear the rigors of incarceration, this Court extends benefit of anticipatory bail to the petitioner subject to her furnishing personal bonds for a sum of Rs. 25000/- with two sureties of the like amount each to the satisfaction of Arresting/Investigating Officer.

However, the petitioner shall join investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. In case the petitioner does not join the investigation, the State is free to move an application for cancellation of her bail.

This order shall also remain subject to the following condition:- i) During monsoon season, the petitioner shall plant 10 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned Police Station where the FIR has been registered and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of her bail. 5.

The petition stands allowed.
