(ORAL) Feeling aggrieved against order dated 2.4.2013 (Annexure P-4) passed by the Additional District Magistrate, Patiala-respondent No.3, whereby arms licence of the petitioner was cancelled, he has approached this Court by way of present writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of Certiorari. Notice of motion was issued and pursuant thereto, reply has been filed on behalf of the respondents.

Learned counsel for the State, on instructions from ASI Gurmail Singh, submits that there were four criminal cases which were being faced by the petitioner at the time of passing the impugned order. He further submits that in one case, cancellation report has already been prepared by the investigating agency and in two other cases, petitioner has already been acquitted. However, learned counsel for the State is not aware about the Amit Kumar 2016.09.15 17:37 I attest to the accuracy and authenticity of this document status of fourth criminal case.

Civil Writ Petition No. 5742 of 2014 After hearing learned counsel for the State and going through record of the case, present writ petition is disposed of with a direction to the Senior Superintendent of Police, Patiala-respondent No.4 to make a clear report about fourth case against the petitioner to the District Magistrate, Patiala. Let the Senior Superintendent of Police, Patiala-respondent No.4 make appropriate report and forward it to the District Magistrate, Patiala, within a period of six weeks from today. Thereafter, the District Magistrate, Patiala, shall reconsider the matter. If, after re-consideration of the matter, petitioner is found entitled for renewal of his arms licence, the same shall be renewed, in accordance with law, otherwise, an appropriate order shall be passed by the District Magistrate, Patiala, under intimation to the petitioner. With the abovesaid observations made and directions issued, present writ petition stands disposed of.
