Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to grant pension and other retiral benefits i.e. Gratuity, Provident Fund and Leave Encashment, etc. to the petitioner for the entire service rendered by him with the department, in view of The Punjab Municipal Employees Pension and General Provident Fund Rules, 1994 as the case of petitioner is covered under the old pension scheme, especially in view of the order passed by this Court in CWP No.14433 of 2011 titled as Gurmail Singh vs. State of Punjab and others decided on 27.05.2015 (Annexure P-5). Further prayer has been made to direct respondent No.4 to decide the legal notice dated 06.04.2026 (Annexure P-7) filed by the petitioner. 2.

Learned counsel for the petitioner submits that he would be satisfied if the legal notice dated 06.04.2026 (Annexure P-7) of the petitioner is NEHA 2026.05.30 15:57 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh

CWP-18419-2026 -2decided by respondent No.4 by passing a speaking order in a time bound manner.

Ms. Roja Agnihotri, Advocate, appearing on advance notice, has caused appearance on behalf of respondent No.4 and files her Memo of Appearance, which is taken on record. The Registry is directed to tag the same at an appropriate place.

Learned State counsel as well as learned counsel for respondent No.4 submits that they have no objection, in case a direction is issued to respondent No.4 for time-bound consideration and decision of the legal notice dated 06.04.2026 (Annexure P-7) of the petitioner by passing a speaking order. 5.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.4 is directed to consider the legal notice dated 06.04.2026 (Annexure P-7) of the petitioner and pass a speaking order in the light of judgment rendered by this Court in Gurmail Singh's case (supra), after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.4.
