(Oral) Petitioner is seeking quashing of action of respondents not to consider the claim of the petitioner for selection and appointment against the category EBPGC and further prayer of the petitioner is for issuance of direction to the respondents to consider his claim for selection and appointment as PGT Economics.

On 12.09.2018, this Court passed the following order:- Learned counsel for the petitioner submits that petitioner has participated in the selection for the post of PGT Economics under EBPGC category being fully eligible as per Advertisement No.4/2015 dated 28.06.2015 wherein total posts were 326 and out of these 18 posts meant for EBPGC Category. As per result, the last candidate in EBPGC category has got 76 marks which is cut off marks fixed by the respondent No.1 and petitioner has got 88 marks, she has not been called for interview. Learned counsel further submits

that since the petitioner had attempted two answers of question No.4, 71 and 78 probably due to this reasons her candidature is not being considered and the petitioner has not been called for interview. Learned counsel for the petitioner submits that petitioner is highly qualified and even if no marks are granted for the above three question still she has scored over and above the cutoff marks of the EBPGC category and if she is granted marks for experience then she would cross the cut off the General Category i.e. 90 marks. Moreover, in her own category for 18 posts only 10 candidates have been called for interview.

In the meantime, petitioner shall be allowed for interview provisionally and her result be kept in the sealed cover.

Today, learned State counsel has produced the result of the petitioner in a sealed cover, which has been opened by Reader of this Court. As per result, the petitioner has secured 96 marks in written examination and 14 in viva voice (total 110 marks) and the last candidate has secured 97 marks under EBPGC category.

Learned counsel for the petitioner submits that 10 posts under EBPGC category are still lying vacant. As per notice (P-5), out of 18 candidates, 10 have been called for interview. Keeping in view of the abvove fact, this petition is being allowed and a direction is issued to respondent to recommend the name of the petitioner for appointment to the post of PGT Economics under EBPGC

category against 08 posts which are lying vacant, within a period of fifteen days, subject to verification of her documents.
