(ORAL) In the present writ petition, the petitioner is praying for the release of arrears of pension from 01.09.2008 till 31.05.2010 as well as the gratuity, which according to him, is being withheld by the respondents.

Counsel for the petitioner states that the petitioner was arrayed as an accused in FIR No.62 dated 16.04.1997, registered at Police Station City Abohar, under Sections 302/307 IPC and Sections 25/27/54 of the Arms Act. The petitioner was convicted and a punishment of life imprisonment was imposed.

CWP-579-2014 -2Counsel for the respondents states that after the conviction of the petitioner in the said FIR, the pension of the petitioner was stopped and now vide order dated 17.01.2018, it was decided that it is only after the decision of the appeal filed by the petitioner against his conviction, decision whether to restore the same or not, will be taken. Counsel for the petitioner states that he be allowed to withdraw the present writ petition and the petitioner be given a liberty to challenge the order dated 17.01.2018 by which the matter regarding restoration of his pension has been kept pending without there being any order to stop the same.

Dismissed as withdrawn, with a liberty to the petitioner to file a fresh petition challenging the order dated 17.01.2018 on all possible grounds.
