The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.233 dated 9.10.2020 at Police Station Sadar Nabha, District Patiala under Sections 323, 452, 506 and 34 of Indian Penal Code.

The allegations, in nutshell, are that the petitioner had entered into the house of complainant and had caused one injury to the complainant and two injuries to his wife.

Learned counsel for the petitioner has submitted the petitioner has falsely been implicated in the present case and that, in any case, all the injuries in question are simple in nature.

Opposing the petition, the learned State counsel has submitted that since the petitioner had entered into the house of injured and had inflicted injuries with the help of a 'spade' including two injuries to a lady, no case for grant of bail is made out.

I have considered rival submissions addressed before this Court. 6.

Without commenting anything on merits of the case and while bearing in mind that it is a case of simple injuries only, the petition is accepted. It is ordered that the petitioner, in the event of arrest, be released on bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.

The aforesaid order is, however, subject to the condition that the petitioner shall pay an amount of `30,000/- as unconditional compensation to the complainant, which may be paid either by way of demand draft or be transmitted in the bank account of the complainant through RTGS or be deposited before the Trial Court, which in case of such deposit shall be released to the complainant. The aforesaid compensation be deposited within a period of one month from today. In case the aforesaid amount is not deposited within the stipulated period, this order shall stand cancelled. It is

( 3 ) further made clear that in case there is any compromise amongst the parties, the aforesaid amount shall stand adjusted.
