(Oral) The petitioner seeks a mandamus to direct the official-respondents to register an FIR in respect of the alleged illegal cutting of 50 trees owned by the Gram Panchayat and which were standing in the open ground of the School premises of the petitioner's village. The trees were allegedly cut on 23.06.2009. It is averred that earlier one Inderjit Singh had filed CWP No.14067 of 2012 in which this Court directed the authorities to take necessary action. Pursuant thereto, some enquiry was held; responsibility was fixed but no criminal case was registered. The petitioner insists that a criminal case ought to have been registered in relation to the above-stated incident of theft of trees.
Having heard learned counsel for the petitioner, we are of the considered view that no direction can be issued by this Court for registration of the FIR except to observe that MOHINDER KUMAR 2016.03.01 14:32 I attest to the accuracy and authenticity of this document Chandigarh
CWP No.3728 of 2016 [2] the petitioner may approach respondent Nos.2 & 3 who in turn are directed to take previous enquiry proceedings to some logical conclusion and if in this process it is found that any cognizable offence has been prima-facie committed, let the law takes its own course. The necessary action shall be taken by respondent Nos.2 & 3 within a period of four months from the date of receiving a certified copy of this order. Ordered accordingly.
