The present petition has been filed under Section 482 BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.85, dated 30.08.2024, under Sections 406, 420, 120-B IPC, registered at Police Station Industrial Area, Chandigarh.

On 13.06.2025, this Court had passed the following order:- "Apprehending arrest the petitioner has filed this petition under Section 482 of BNSS for grant of anticipatory bail in case bearing FIR No.85 dated 30.08.2024, under Sections 406, 420 and 120-B IPC, registered at Police Station Industrial Area, Chandigarh.

Learned counsel for the petitioner inter alia submits that admittedly, the petitioner took a car loan from the ICICI Bank, and out of the sanctioned amount of Rs.16 lakhs, a sum of Rs.14.90 lakhs was disbursed to him. It is submitted that Rs.2.50 lakhs already stand repaid, and to show his bona fide, the petitioner is willing to make another payment of the same amount i.e. Rs.2.50 lakhs to the bank within a period of one week. In light of this, learned counsel submits that matter be referred to Mediation and Conciliation Centre of this Court to facilitate an amicable resolution to the dipsute.

4. At asking of Court, Mr. Balram Singh, APP, UT, Chandigarh, who is present in Court, accepts notice on behalf of respondent(State), and seeks time to file status report.

5. Meanwhile, the petitioner is directed to join the investigation and appear before the investigating agency as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. 6. At this stage, on oral request of counsel for the petitioner, ICICI Bank-complainant, is hereby impleaded as respondent No.2. Mr. Sherry Singla, Advocate for respondent No.2, who is appearing through video conferencing, accepts notice on their behalf.

7. Learned counsel for the petitioner is directed to file amended memo of parties in the registry within a period of three days, without moving any separate application.

8. Both the parties are directed to appear before the Mediation and Conciliation Centre of this Court on 02.07.2025 at 11:00 AM.

9. List on 28.07.2025 for awaiting the report." 3.

Learned counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, he shall make himself available without demur.

Learned counsel for the UT Chandigarh on instructions from the investigation officer affirms the factum of joining the investigation by the petitioner and cooperating with the investigating agency. He also submits that at this stage, the petitioner is not required for further custodial interrogation. 5.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 13.06.2025 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
