The petitioner, who is a contractor and allegedly executed various works assigned to him, seeks a writ in the nature of mandamus directing the respondents to release payment due on account of the work done.
Counsel for the petitioner submits that the petitioner will be satisfied, at this stage, in case his legal notice dated 2.1.2017 (Annexure P3) sent to Executive Engineer, Bathinda Canal Division, Bathindarespondent No.4, is disposed of expeditiously. Notice of motion. On asking of the Court, notice has been accepted by Ms. Anu Pal, AAG, Punjab. Copy given. Without expression of any opinion regarding the right/ claim of the petitioner, this petition is disposed of, at this stage, with a direction to Executive Engineer, Bathinda Canal Division, Bathinda- respondent No.4 to consider the claim of the petitioner in legal notice dated 2.1.2017 (Annexure P-3) within a period of two months after the receipt of a certified copy of this order by passing a speaking order. In case of entitlement of the petitioner of any due, necessary steps thereafter may be taken expeditiously.
