*** Daya Chaudhary, J. (Oral) Petitioner-Mustak Ali has approached this Court by way of filing the present writ petition under Articles 226 and 227 of the Constitution of India for quashing of impugned order dated 13.09.2020 (Annexure P-3) passed by respondent No.3 i.e. Mining Officer, Department of Mines Minerals & Geology, Faridabad, whereby, his vehicle has been stated to be seized in an illegal manner.
While hearing arguments raised by learned counsel for the petitioner, it has come to the notice of this Court that the appeal filed by the petitioner is still pending and no order has been passed thereupon. Learned counsel for the petitioner submits that the petitioner would be satisfied in case, direction is issued to the appellate authority to decide the pending appeal expeditiously as the petitioner is loosing his right of livelihood because of seizure of vehicle.

By considering the submission made by learned counsel for the petitioner and without saying anything on the merits of the case, the present writ petition is disposed of with a direction to respondent No.2 to decide the pending appeal dated 17.09.2020 (Annexure P-5) in accordance with law preferably within a period of two weeks from the date of receipt of certified copy of this order.
However, in case, for any sufficient reason, the appeal is not heard within the stipulated period, then the same be adjourned for a shorter date and be decided within a period of one week thereafter.
