CWP No. 5853 of 2014 Learned counsel for the petitioner submits that regarding claim of the petitioner, he has already served a legal notice, Annexure P4. According to him, in a similar case i.e. CWP No. 22127 of 2027 decided on 05.10.2013, this court has directed the respondents to consider the claim of a similarly placed employee.

Under the circumstances, this writ petition is disposed of with a direction that respondents shall consider the claim of the petitioner as made out in legal notice, Annexure P4 and pass a AJAY KUMAR 2015.02.21 11:52 I attest to the accuracy and authenticity of this document

CWP No. 5853 of 2014 (O&M) speaking order within a period of two months of receipt of certified copy of this order. In case petitioner is found entitled to the pensionary benefits, same shall be released to him within one month of the speaking order.
