RAJIVE BHALLA, J.(Oral) The petitioner's prayer is for issuance of a writ of mandamus to decide the petitioner's case for refund expeditiously. Counsel for the petitioner submits that in an appeal filed by the petitioner, the matter was remitted to respondent No.4 to decide the same. Despite the order in appeal having been passed on 6.11.2006, and repeated request by the petitioner, the Assistant Excise and Taxation Commissioner, Gurdaspur, has not decided the petitioner's claim for refund.

We have heard counsel for the petitioner and without expressing any opinion on the merits of the controversy, dispose of this petition and direct respondent No.4 to decide the petitioner's prayer for refund within two months from the receipt of certified copy of this order.
