IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH.

CWP No.23238 of 2018 (O & M) Date of Decision: September 13, 2018 Ramandeep Singh ......PETITIONER(s).

VERSUS

State of Punjab and others ....RESPONDENT(s).

CORAM:- HON'BLE MR. JUSTICE JASWANT SINGH

Present:

Mr. Harpreet S. Rakhra, Advocate for the petitioner.

JASWANT SINGH, J. (ORAL) The petitioner was enlisted as a Constable, Indian Reserved Battalion, Punjab on 21.08.2007. He is stated to have been sent out on deputation to the CID Unit in November, 2012. By filing the present petition, the petitioner has laid challenge to the order dated 31.08.2018 whereby the DGP Intelligence, Punjab has repatriated the petitioner to his parent unit i.e. 4th IRB, Shahpur Kandi, Pathankot.

Counsel for the petitioner heard.

It is conceded by the counsel for the petitioner that the Constable cannot remain on deputation beyond the period of three years extendable to another two years. It is also not in dispute that the Intelligence Wing of the Punjab Police has now been constituted as a separate cadre, by framing the statutory rules in the year 2015. Since the independent cadre in the Intelligence Wing has been established, the necessary consequence of repatriation of the persons on deputation back to AMIT KAUNDAL 2018.09.18 17:12 I attest to the accuracy and integrity of this document

CWP No.23238 of 2018 (O & M) -2the parent department has not caused any prejudice. Dismissed.
