(ORAL) The prayer in the present petition under Section 528 of the BNSS, 2023 is for quashing of the order dated 12.01.2026 (Annexure P-1) passed by the SDJM, Ajnala, whereby the application/complaint dated 18.05.2024 (Annexure P-2) filed by the petitioner under Section 156(3) of Cr.P.C. seeking registration of an FIR has been dismissed. The learned counsel for the petitioner contends that the petitioner was beaten up on 28.11.2023 and thereafter on 29.11.2023 by the private respondents. A medico-legal examination took place. Despite making representations to the Investigating Agency, no action was taken as regards registration of an FIR. Therefore, an application was moved under Section 156(3) of Cr.P.C. on 18.05.2025 (Annexure P-2). The said application was dismissed vide impugned order dated 12.01.2026 (Annexure P-1). CRM-M-32614-2026 -2I have heard the learned counsel for the petitioner and gone through the file.

A persual of the same would reveal that the petitioner was purportedly beaten up on 28.11.2023 and thereafter on 29.11.2023. He is alleged to have made an application to the Investigating Agency for registration of an FIR and no such FIR has been registered. For reasons best known to the petitioner, he has chosen to file an application under Section 156(3) Cr.P.C. on 18.05.2026 i.e. 06 months after the occurrence. On the said application, the impugned order was passed on 12.01.2026 (Annexure P-1). Firstly, there is a delay of 06 months seeking registration of an FIR which stands unexplained. Secondly, even after the impugned order was passed on 12.01.2026 the petitioner has sat over his rights for a period of 06 months. No attempt has been made by him to file a private complaint before the competent Court. In view of the above, I find no merit in the present petition. Therefore, the same stands dismissed.

However, the petitioner is at liberty to avail his alternative remedies in accordance with law.
