The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to Grant him permission to construct a Memorial Gate in the Honour of Martyr Sardar Joginder Singh who attained martyrdom while defending the sovereignty and integrity of the nation in the line of duty on 20.11.1971 while serving in 22 Punjab Regiment during the Indo-Pak War of 1971.

The petitioner is real brother of Late Joginder Singh s/o Harnam Singh who attained martyrdom in the line of duty during IndoPak War of 1971. He has proposed to respondents to construct a memorial gate in the honor of his brother at the entrance on the road Shahib Bibi Sundri via Naushera leading to Village Nawa Shala within the revenue limits of Village Bahadar Tehsil and District Gurdaspur. CWP-18456-2026 (O&M) -2and homage to his late brother. He does not seek any financial grant or aid from government/District Administration or any public authority. The proposed memorial gate's design, dimensions and specifications shall strictly conform to the applicable Rules, Regulations and safety norms prescribed by the authorities and he is willing to make any modifications or alterations as may be suggested by the respondents to ensure compliance with legal and administrative requirements. The structure is not intended for any commercial, political or private benefit but solely for the purpose of paying tribute to the Martyr. He has preferred representation dated 16.03.2026 in that regard but to no avail. 3.

Learned State counsel submits that, as on day, there is no policy in relation to demand raised by the petitioner. 4.

In the wake of statement of learned State counsel, the petition stands disposed of. This order shall not inhibit respondent to consider petitioner's request at any subsequent stage. 5.
