In a suit seeking decree of permanent injunction, plaintiff (petitioner herein) moved an application for temporary injunction and prayed for grant of ad interim injunction. By virtue of the order dated 19.05.2025 (Annexure P6), learned Civil Judge (Jr. Divn.), Kurukshetra, observed that there was no prima facie case for grant of ad interim injunction and as such, declined the relief. The said order was assailed before the Appellate Court. Learned Additional District Judge, Kurukshetra by way of order dated 31.05.2025 (Annexure P8) observed that at that stage, there was no prima facie case against the respondents for granting ex parte stay and that the matter needed consideration after notice to them. As such, declining the stay at that stage, notice to the contesting respondents was directed to be issued for 01.07.2025 i.e. for today.

The aforesaid order is assailed before this Court. 3.

Simply because notice of the appeal has been issued to the opposite party by the appellate court before considering the grant of exparte injunction, cannot be a ground to approach this court in revision. 6.

As such, no ground is made out to interfere in the impugned order. Dismissed.
