***** MANJARI NEHRU KAUL, J. (ORAL) The petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C., in case FIR No.128 dated 13.10.2022, under Sections 452/ 323/ 427/ 148/ 149 of IPC, registered at Police Station Longowal, District Sangrur. 2.

On the last date of hearing, i.e., on 02.08.2023, while noticing the following submissions made by the learned counsel for the petitioner, this Court, had granted the concession of interim bail to the petitioner and asked him to join investigation:- "Learned counsel for the petitioner while drawing the attention of this Court to the FIR annexed as Annexure P-1, submits that a perusal of the same clearly reveals that he was not named therein and came to be nominated as an accused in the supplementary statement of the complainant, which was made much later in time, wherein it was alleged that the petitioner had also accompanied the co-accused when they trespassed into his house and assaulted him and his family members besides damaging his household articles. It has been further submitted that even otherwise injuries allegedly received by the complainant party were also simple in nature. He further submits that the petitioner is ready to join investigation and cooperate with the investigating agency." 3.

Learned counsel for the petitioner submits that in compliance of order dated 02.08.2023, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. She, MAHAVIR SINGH 2023.11.20 10:40 I attest to the accuracy and authenticity of this order/ judgment

2023:PHHC:145099 CRM-M-37305-2023 (O&M) on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 02.08.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
