IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 3860 of 2016 Date of decision: 26.02.2016 Varinder Kumar and others ....Petitioner(s)

Versus

Board of Directors, The Punjab State Cooperative Supply and Marketing Federation Ltd. and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Amit Sharma, Advocate, for the petitioners.

G.S.SANDHAWALIA, J. (Oral) The petitioners seek the revised pay scale of 510-800 w.e.f. 01.07.1981 and 950-1800 w.e.f. 01.01.1986 and other higher pay scales given to the identically placed posts of Laboratory Attendants alongwith interest.

It is the case of the petitioners that they are working as Valveman-cum-Mochi with the respondent-Federation. On 27.07.1992 (Annexure P-3), a decision had been taken to place them alongwith Laboratory Attendants in the semi skilled category and the pay scales were similar. The same was repeated on 23.07.1993 (Annexure P-4). However, the benefit of revised pay scales had been given to the Laboratory Attendants to the tune of 510-800 w.e.f. 01.07.1981 but no such revision has been made for the category of the petitioners. Counsel for the petitioner submits that a legal notice dated 14.10.2015 (Annexure P-7) has already been served upon the respondentSHIVANI GUPTA 2016.02.29 13:54 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 3860 of 2016 Federation for the necessary relief but no action has been taken. Counsel submits that he would be satisfied if a direction is issued to the said respondent to take a decision on the said legal notice within a time bound frame.

Keeping in view the limited relief sought, this Court does not feel it necessary to call upon the respondents to file reply. Accordingly, without commenting on the merits of the case, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the legal notice dated 14.10.2015 (Annexure P-7) and decide the same within a period of 4 months from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, a speaking order be passed and conveyed to the petitioners. 26.02.2016 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2016.02.29 13:54 I attest to the accuracy and integrity of this document Chandigarh
