The petition under Section 528 of Bhartiya Nagarik Suraksha Sanhita, 2023, seeks the following reliefs:- (i) Direction to learned trial Court to independently investigate and register FIR in case No. CRM/1467/2025 at JMIC, Kharar, SAS Nagar, Mohali.

(ii) Direction to learned trial Court to dispose of the matter under Section 175(3) BNSS within a fixed time frame. (iii) Direction to Vigilance Bureau, Government of Punjab or Central Bureau of Investigation to register FIR and independently investigate the matter.

Learned counsel for the petitioner submits that petitioner filed an application under Section 175(3) BNSS, 2023 before the Court of learned JMIC at Kharar on 19.12.2025 for registration of FIR. Learned JMIC, Kharar called for report of the SHO on the same day but the report was not SUMIT SINGLA 2026.06.01 15:14 I attest to the accuracy and integrity of this document

CRM-M-32414-2026 (O&M) -2submitted on 20.01.2026, 25.02.2026, 24.03.2026, 06.05.2026 and 20.05.2026 on which account, the application was being adjourned time and again. He further submits that a cognizable offence was made out from the allegations in the complaint but the Court of learned JMIC, Kharar was keeping the complaint pending awaiting report of the SHO concerned. Limited prayer is for necessary directions to learned trial Court to dispose of the matter within a fixed time frame.

Notice of motion to official respondents.

Mr. Bareen Pratap Singh, AAG, Punjab, accepts notice on behalf of official respondents only. On instructions from ASI Kesar Singh, he submits that SHO, Police Station Mullanpur would file the required report on the next date of hearing i.e. 10.06.2026 and the matter would not be delayed further.

SHO, Police Station Mullanpur would be bound to file report on 10.06.2026, as submitted. On the report being filed, learned JMIC, Kharar shall dispose of the matter expeditiously.

The petition stands disposed of.

All the pending miscellaneous applications, if any, stand disposed of.
