Through instant civil writ petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to recalculate the retiral benefits as per revised salary and also after granting him the benefit of Rule 3.17-A proviso (a) of Punjab Civil Services, Vol. II to pay the same and also to pay the leave encashment for full 300 days. And further to pay interest @ 18% per annum on the retiral benefits from the date of retirement till the date of realization. 2.

Learned counsel for the petitioner contends that though legal notice dated 15.05.2017 (P-2) was duly served upon the respondents but till date neither any reply to the said legal notice has been received nor any final order has been passed by the respondents. Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondent(s) to look into the grievances unfolded by the petitioner in legal notice dated 15.05.2017 (P-2) and to take a conscious decision, within a period of three months from the date of receipt of a certified copy of this order.

However, if petitioner still feels aggrieved by any of the orders passed by the aforesaid authority, he shall be at liberty to approach this Court or to have recourse to the other remedies available under law.
