IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 4032 of 2016 Date of decision: 29.02.2016 Balbir Singh ....Petitioner(s)

Versus

State of Punjab and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. A.S. Dhaliwal, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) The petitioner challenges the order dated 10.02.2016 (Annexure P-1) whereby, he has been transferred from Moga to Commissionorate Ludhiana.

The argument raised is that he was transferred on the basis of a complaint and, therefore, the petitioner should have been given an opportunity to be heard.

Admittedly, the petitioner has been posted at Moga since the year 2000 and, therefore, if he has been transferred after a period of 16 years in the exigencies of administration, no fault can be found. It is settled principle that the orders of transfer are not to be easily interfered with. In such circumstances, this Court is not to opine on the transfer order and the writ petition is accordingly dismissed. 29.02.2016 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2016.03.02 12:36 I attest to the accuracy and integrity of this document Chandigarh
