In the present writ petition, the petitioner has challenged the letter dated 30.05.2025 (Annexure P-12) to an extent that the case of family pension of the petitioner has been closed on account of non-furnishing of the 'No Enquiry Certificate'.

Learned counsel appearing on behalf of the petitioner submits that a perusal of the impugned letter dated 30.05.2025 (Annexure P-12) would show that the reason for not releasing the family pension to the petitioner is that the 'No Enquiry Certificate' was not furnished by the Department to respondent No.5. Learned counsel further submits that the 'No Enquiry Certificate' has to be furnished by the Department to the office of Accountant General, Punjab and there is no fault of the petitioner in regard to nonfurnishing of the 'No Enquiry Certificate'. Learned counsel, on instructions from the petitioner, submits that at this stage, the petitioner will be satisfied

CWP-18489-2026 -2if a direction is given to respondent No.4 to reconsider the case of the petitioner for issuance of the 'No Enquiry Certificate' for the purpose of grant of family pension.

Mr. N. P. S. Hira, DAG, Punjab, accepts notice on behalf of the respondents. He, on instructions submits that the case of the petitioner will be reconsidered for grant of 'No Enquiry Certificate' for the purpose of grant of family pension within 08 weeks from the date of receipt of certified copy of this order.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.4 to reconsider and decide the case of the petitioner as per the law for issuance of 'No Enquiry Certificate' for the purpose of family pension within the abovesaid period. In case, the petitioner is held entitled for family pension as per the law/rules, the same be released to the petitioner within a period of 02 months thereafter.
