In the present petition, the petitioners are praying for issuance of a writ in the nature of Mandamus directing the respondents to issue "Benefit Certificate" for exemption from payment of stamp duty and registration charges.

Learned counsel appearing on behalf of the petitioners submits that the land belonging to the petitioners was acquired for the purpose of widening of National Highway No.71 (Sangrur to Punjab/Haryana Border Section) in District Sangrur vide order dated 31.10.2014. He further submits that consequent upon the acquisition, the petitioners were awarded compensation. Thereafter, the petitioners approached the respondents on several occasions for grant of "Benefit Certificate" (Stamp Duty Exemption Certificate) on account of compulsory acquisition of their land. However, despite repeated representations, the said certificate has not been issued till date.

Learned counsel appearing on behalf of the petitioners, on instructions from the petitioners, submits that at this stage, petitioners will be satisfied if a direction is given to respondent No.3/Competent Authority i.e. Sub Divisional Magistrate, Tehsil Moonak, District Sangrur to treat the present writ petition as representation and decide the same, in a time bound manner.

Mr. Rishi Kaushal, Advocate, accepts notice on behalf of respondents No.1 and 2; whereas Mr. Rohit Ahuja, learned Deputy Advocate General, Punjab, accepts notice on behalf of respondent No.3. They both do not oppose the prayer made by learned counsel for the petitioners. 6.

In view of the above and without commenting upon the merits of the case, the present petition is hereby disposed of with a direction to respondent No.3/Competent Authority i.e. Sub Divisional Magistrate, Tehsil Moonak, District Sangrur to treat the present writ petition as representation and decide the same, within a period of two months from the date of receipt of certified copy of this order, in accordance with law/rule. 7.
