AMIT RAWAL J. (Oral) Learned counsel for the petitioners seeks leave of the Court for withdrawal of the present writ petition with liberty to challenge the registered exchange deed by filing a civil suit provided that they will move an appropriate application seeking condonation of delay under Section 14 of the Limitation Act which shall be considered sympathetically as they were pursuing the proceedings in this Court in good faith. The stay will remain in operation, if the suit is filed within a period of one month from the date of receipt of certified copy of this Court. This order would not influence the trial Court for adjudication of the application under Order 39 Rules 1 and 2 of the Code of Civil Procedure which shall be decided in accordance with law.
