Instant petition has been filed under Articles 226/227 of the Constitution of India for quashing the circular dated 29.07.2003 (Annexure P-1) vide which the table of circulation of commutation of pension was replaced to the disadvantageous position for those who retired on or after 31.07.2003 as the same was restored w.e.f. 31.10.2006 (Annexure P-6) and for directing the respondents to pay lump sum payment payable to the petitioners on commutation of pension in accordance with the table which was existing before the issuance of the memo dated 29.07.2003 and was restored vide memo dated 31.10.2006 (Annexure P-6). Further prayer has been made for payment of interest to the petitioners @ 12% from the date when it became due till its realisation.

After arguing the case for some time and realising that this Court is not inclined to interfere in the matter as there is a considerable delay in approaching the department as well as this Court, learned counsel for the petitioners wishes to withdraw the instant petition. 3.
