(ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in FIR No.112 dated 29.10.2020, under Section 61 of the Punjab Excise Act, 1914, registered at Police Station Cheema, District Sangrur. It has been submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in the present case only because of enmity in the village and even as per the story 70 litres of lahan was recovered which was totally a concocted story as the same was RAJ KUMAR ARORA 2021.01.13 10:14 I attest to the accuracy and integrity of this document
CRM-M-38278-2020 (O&M) allegedly recovered from the cattle house of the petitioner and in fact, it was only because of the political rivalry that the petitioner has been roped in the present case. It has been also submitted that the petitioner does not have any bad antecedents and is not involved in any other case with regard to recovery of illicit liquor.
On 19.11.2020, interim protection was granted to the petitioner and he was directed to join investigation and to abide by the conditions contained in Section 438 (2) Cr.P.C. Learned State counsel, on instructions from ASI Jasbir Singh, has submitted that in pursuance of the orders passed by this Court, the petitioner has joined investigation and has fully cooperated with the investigation process and is not required for custodial investigation. In view of the above stand taken by the learned State counsel, the present petition is allowed. Interim order dated 19.11.2020, is hereby made absolute.
