JASWANT SINGH, J. (ORAL) The petitioner is serving as Panchayat Secretary in Gram Panchayat Mohar Singh Wala, Block Bhikhi, District Mansa. There are allegations of forging the signatures of Panches in the proceeding books and resolutions regarding selling of green trees without auction and misuse of grants and lease money to the tune of Rs.50 lac. The petitioner by filing the instant petition is seeking the issuance of writ in the nature of mandamus directing the Deputy Superintendent of Police, Sub Division, Mansa - respondent No.5, not to initiate any inquiry in the light of previous inquiries with regard to the same allegations conducted by the Additional Deputy Commissioner RAJ KUMAR ARORA 2018.10.12 10:27 I attest to the accuracy and integrity of this document

After hearing the counsel for the petitioner no case for issuance of writ of mandamus is made out as in the light of serious allegations, the Deputy Superintendent of Police,Vigilance Bureau, Mansa, is conducting a fact finding inquiry to examine whether any offence or misconduct against the petitioner is made out or not. Merely because certain fact finding inquiries were earlier made would not provide the basis for invoking the principle of double jeopardy as concededly till today neither any departmental action has been initiated against the petitioner nor any criminal trial has resulted in his acquittal. In view of above, no case for invoking the writ jurisdiction is made out, as such, the writ petition is dismissed. (JASWANT SINGH) JUDGE October 9, 2018.
