Prayer in the present petition filed under Section 528 of the 'Bharatiya Nagarik Suraksha Sanhita', 2023 is for extension of another period of 06 months to stay abroad to carry on studies of Advance Diploma in Information and Technology during the pendency of proceedings. 2.
A status report, dated 09.08.2024, by way of an affidavit of Sh. Satish Kumar, HPS, Deputy Superintendent of Police, Assandh, has already been filed by learned State counsel. The same is taken on record. A short reply has also been filed by respondent No. 2, which also taken on record. 3.
The petitioner was earlier allowed to visit Australia for a period of six months, vide order dated 30.01.2024, passed in CRM-M-58394-2023 (Annexure P-15).

The present petition has been filed for seeking extension of time to surrender before the trial Court.

Counsel for the petitioner submits that the petitioner undertakes to surrender before the trial Court on the next date of hearing, i.e. 09.10.2024.

The said prayer has not been objected by counsel appearing for respondent No. 2.

Keeping in view the above, the present petition is disposed of accordingly. The period granted to the petitioner to visit abroad, i.e. Australia is extended till 08.10.2024 and the petitioner shall surrender before the trial Court on 09.10.2024.

It is made clear that the petitioner shall remain bound by the undertaking given on his behalf by his counsel in Court today. 9.
Pending miscellaneous application(s), if any, shall also stand disposed of.
