This is a petition for quashing the order dated 21.9.2021 (Annexure P-2) passed by the Sessions Judge, whereby the amount of interim maintenance granted to the respondent/wife under Section 125 Cr.P.C. was enhanced from Rs.5500/- per month to Rs.13,000/- per month. A perusal of the order shows that the amount of interim maintenance has been awarded on the basis of admitted gross salary of the petitioner/husband, Rs.41,716/-.

In view thereof, there is no ground to entertain this petition as the amount awarded is not on a higher side. Besides, it has been awarded by way of interim maintenance to the respondent/wife and the minor child which is subject to final adjudication of the issue after trial. The petition is accordingly dismissed with the observation that the trial Court shall decide the main case on merits, without being influenced by the observations made by the Sessions Judge in the impugned order.
