The said appeal is pending before the Appellate Authority, namely, the Commissioner of Income Tax (Appeals), Chandigarh. The petitioner also applied for stay but no order has been passed on its stay application. Meanwhile, the Assessing Authority has issued final demand notice.
Since the petitioner has sought interim stay, it is imperative upon the Appellate Authority to decide such application in accordance with law. We thus dispose of this writ petition with a direction to the Appellate Authority to decide the stay application moved/to be moved by the petitioner, uninfluenced of the rejection of the stay of demand MOHINDER KUMAR 2016.03.10 11:33 I attest to the accuracy and authenticity of this document Chandigarh
