**** RITU BAHRI , J. (Oral) Learned counsel submits that in November, 2017, the posts of Resident Audit Officer were fell vacant against promotion quota and the Departmental Promotion Committee recommended the case of the petitioner for promotion to the post of Resident Audit Officer . The case was further forwarded to the competent authority but the same was returned by the department assigning the reason i.e lapse on the part of the department. The petitioner has given representation dated 05.03.2018 (P-2) and reminder dated 30.04.2018 (P-3) but till date no action has been taken. Learned counsel has referred to instructions issued by the Chief Secretary to Government of Haryana dated 11.09.2016 (P-4), wherein in Para I (iii), it has been clearly stated that such cases should be initiated immediately on the accrual of vacancy and as far as possible should be finalized within a period of three months.

In view of the above factual position, this petition, at this stage is being disposed of without expressing any opinion on the merits of the case, by giving a direction to respondents to pass an appropriate orders on representation dated 05.03.2018 (P-2) and reminder dated 30.04.2018 (P-3) of the petitioner, in accordance with law and instructions mentioned abvoe, expeditiously.
