M.M.S. BEDI, J. (ORAL) Vide order dated 4.10.2017, a direction was issued to the parties to appear before the Mediation and Conciliation Centre of Punjab and Haryana High Court. The appellant has neither put in appearance before the Mediation and Conciliation Centre of Punjab and Haryana High Court nor counsel for the appellant has been able to have a contact with the appellant.

We have gone through the facts and circumstances of the case. The appellant-husband had filed a petition for divorce before the District Judge, Sri Muktsar Sahib which was dismissed. Aggrieved against the order of dismissal, the appellant has preferred the present appeal. The appellant was required to pay a sum of Rs.15,000/- towards interim Raj Kumar Arora 2018.02.22 13:44 I attest to the accuracy and integrity of this document

FAO-M-169-2011 (O&M) litigation expenses to the respondent-wife but on account of non-payment of the amount of Rs.15,000/- and for not putting in appearance before the Mediation and Conciliation Centre of Punjab and Haryana High Court, it appears that the appellant is not interested in pursuing his petition for divorce.

On asking of the Court, counsel for the appellant submits that the appellant is not responding to any communication and it is not possible for him to contact him.

In view of above said circumstances, the appeal is dismissed for non-compliance of the interim orders passed by this Court for payment subject a condition that in case within a period of one month, the appellant approaches this Court along with the amount as ordered, payable to the respondent, the appeal may be considered for restoration.
