HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.0055 dated 08.05.2021 under Sections 452,427,506,148,149 IPC registered at P.S Garhshankar, District Hoshiarpur.

FIR was lodged on the complaint of one Sonu, who stated that he was working at Durga Filling Station, Kukkar Majara. He was working as Salesman at the petrol pump. On 08.05.2021, he along with Manoj Bhardwaj was present at the petrol pump. At about 2.30 a.m, 8-9 persons came there on three motorcycles. They were armed with gandasis and kirpans. They broke certain articles and office windows with their weapons. Complainant and his companions hid themselves in the dark. Thereafter, accused went away.

On 03.06.2021, Paramjit Singh got recorded his statement that the petrol pump is in the name of his wife and he was managing the same. Learned counsel for the petitioner contends that name of the petitioner does not figure in the FIR. His named has surfaced due to party faction in the village. Investigation in this case is complete and challan has been filed. The petitioner has been in custody since 23.07.2021 and that there is no other criminal case registered against the petitioner. Without commenting anything on the merits of the case and also bearing in mind the fact that the trial is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Manpreet Singh Rai is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly.
