G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the benefit of revised pension and other retiral benefits and for release of the arrears of the revised pension with interest @ 9% as per the policy framed by the Punjab Government (Annexure P-1) regarding the recommendations of the 5th Pay Commission. It is the case of the petitioner that he retired as Assistant Lines Man on 31.05.2006 and is drawing pension since 03.01.2007. It is further his case that the legal notice dated 03.12.2015 (Annexure P-5) was also served upon respondents no. 2, 4 and 6 and he would be satisfied if the same is decided within a time bound frame.

Keeping in view the limited relief sought, this Court is of the opinion that there is no need to call for the respondents to file reply. Accordingly, without commenting on the merits of the case and the liability of the respondents, the writ petition is disposed of with a direction to respondent no. 4 or the competent authority to decide the legal notice dated 03.12.2015 (Annexure P-5) within a period of 3 months from the date of receipt of certified copy of the order. If the amount is found to be due and there is no legal impediment, the same shall be paid to the petitioner within a period of 1 month thereafter. Needless to say if the relief is to be denied, a reasoned order be passed and conveyed to the petitioner.
