By an order dated 30.08.2013, the above appeal was directed to be heard with Arbitration Case No.82 of 2011. Arbitration Case No.82 of 2011 is a petition under Section 11 of the Arbitration and Conciliation Act, 1996 for the appointment of an arbitrator. I have, by a separate order and judgment passed today, dismissed the petition holding that there is no arbitration agreement between the parties. The above appeal is against an order dismissing the appellant's petition under Section 9 of the Act for interim reliefs.
