Present criminal writ petition under Article 226/227 of the Constitution of India read with 528 of BNSS has been filed for issuance of writ in the nature of habeas corpus and for appointment of warrant officer, with a roving writ to search for the detenue, namely, Ms. Gouri Kumar, who has been illegally detained/confined by respondent No.3 and hand over custody to the petitioner.

On 27.05.2026, this Court passed the following order:- "Prayer in the present petition is for seeking production of detenue namely, Gouri Kumari, who is alleged to have been illegally detained by respondent No.3. Notice of motion for 03.06.2026.
The Superintendent of Police, Nuh, is directed to SONIKA 2026.06.03 14:38 I attest to the accuracy and authenticity of this document

Today, the detenue, namely, Gouri Kumari has been produced in Court by SI Bheem Singh, Constable Priyanka and Constable Parveen, Nuh from One Stop Room, Nuh, who was lodged there in pursuance to a complaint received at 112. Furthermore, she is sound and safe and is not in any illegal custody of respondent No.3, rather, she was at a safe house at One Stop Room, Nuh.
3.1 Upon interaction with detenue through Ms. Komal Sharma, DAG, Haryana, she submits that she is not under coercion and is mentally competent and intends to live with petitioner on her own will and wish. 4.
In view of the above, no case of illegal dentention survives, as such, the same stands disposed of. The detenue is set at liberty to reside at a place of her own choice. However, if at any stage, the detenue requires protection, it shall be open to her to approach jurisdictional police authorities.
