In view of averments made in the application and arguments advanced by counsel for the applicant, the application is allowed and delay of 19 days in filing the instant petition is condoned. CRM- 27992 of 2019 3.

The petitioner through the instant petition under Section 401 Cr.P.C. is seeking modification of order dated 26.04.2019 whereby Sessions Judge, Ferozepur has decreased amount of PARAMJIT KAUR SAINI 2023.05.25 17:09 I attest to the accuracy and authenticity of this order/judgment

 

CRR-2313 of 2019 (O&M) -2maintenance awarded by JMIC, Zeera from Rs. 6000/- per month to Rs. 3000/- per month.

The present petition was filed in 2019 assailing order of Sessions Court passed on 26.04.2019 by which order dated 20.09.2018 was modified. The petition under Section 125 Cr.P.C. of the petitioner is pending before trial court since April' 2018. 6.

Learned counsel for the parties are ad idem that question of determination of final maintenance is at final stage, thus, they have no objection if present petition is disposed of with a direction to trial court to decide final maintenance expeditiously. 7.

In view of statement of counsel for the parties and considering the fact that petition seeking maintenance is pending before trial Court since 2018, the trial court is requested to decide final maintenance expeditiously and preferably within three months from the date of receipt of certified copy of this order. 8.

The trial court shall decide final maintenance without being prejudiced by order passed by Sessions Court as well this Court. 9.

Disposed of.
