State of Punjab and others .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Pankaj Gupta,Advocate for the petitioner Mr.V.Ramsarup,Addl.AG Punjab Jaswant Singh,J.(Oral) The Auction Purchaser of 140 square yards of land, subject matter of the dispute, purchased vide sale deed dated 11.7.2013 through Authorised Officer of the IDBI Bank before whom the land was mortgaged, is in writ jurisdiction before this court seeking a direction to the revenue officials of Derabassi to record his mutation. It is stated that due to default of the principal borrower the mortgaged property comprising a residential house was auctioned and purchased by the petitioner with possession. It transpires that the principal borrower had fraudulently sold the said residential house vide sale deed dated 4.6.2010 to one Mukesh Gandhi and Smt.
Gurjeet Kaur and accordingly a mutation in their favour had been effected. Thus, prayer is for cancellation of the previous mutation and recording of fresh mutation RAJINDER PRASHAD JOSHI 2015.05.01 10:07 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CWP 5292/2015 on account of legal and valid sale deed in their favour. Upon notice, Mr.V.Ramsarup,learned Addl.AG Punjab on instructions from Smt.Harpreet Kaur, Naib Tehsildar,Derabassi states that appropriate action in accordance with law shall be taken within two months from today.
In response, learned counsel for the petitioner submits that no further adjudication is required.
In view of the aforesaid agreed stand present writ petition is disposed of as having become infructuous.
