Sandhawalia, J.(Oral) Apparently, the challenge in the present petition, filed under Articles 226/227 of the Constitution of India, is to the notification dated 29.01.2002 (Annexure P-2) issued under Section 4 of the Land Acquisition Act, 1894 (for short 'the Act') and the subsequent notification dated 16.01.2003 (Annexure P-3) issued under Section 6 of the Act and the draft Award dated 25.05.2007 (Annexure P-6) announced under Section 11 of the Act of 1894, which never culminated in the final Award. 2.

The stand of the State as such is also to the same effect that the land of the petitioner has not been acquired and on an earlier occasion, Civil Suit for permanent injunction was filed by the petitioner. It is submitted that the possession has also not been interfered with and therefore, the NEETU RANI 2024.09.26 11:06 I attest to the accuracy and authenticity of this order/judgment PHHC, CHD

CWP No.25623 of 2017 -2compensation to the petitioner has not been granted till date and the petitioner is still in possession of the land. The answering respondent has stated that it will abide by to pay the requisite compensation to the petitioner, whenever his land will be acquired as per the law and through proper procedure.

Keeping in view the above, we are of the considered opinion that the present writ petition has been rendered infructuous in view of the stand taken by the State itself and the same is disposed of accordingly.
